Privacy Policy

1. Scope

This Privacy Policy explains how Limitless Labs Inc. handles information when you use XEL, including xel.xyz, our apps, interfaces, APIs, hosted runtime features, Character pages, and related services together called the Services.

It does not cover public blockchains, decentralized storage networks, wallet providers, payment processors, AI providers, or other third-party services that operate independently from us. Their own terms and policies apply.

2. What We Collect

• Account information, such as email address, display name, profile details, sign-in records, and support messages.
• Wallet and blockchain information, such as public wallet addresses, transaction references, ownership records, and on-chain activity.
• Character content, such as persona prompts, memory, instructions, files, images, audio, video, profile details, and conversations.
• Voice, likeness, and consent records if you use features involving a real person's voice, image, likeness, or persona.
• Payment and funding information, such as credits, balances, refunds, tips, fees, endowment activity, payment processor records, and public on-chain payment records.
• Usage, device, cookie, security, anti-abuse, and approximate location data.
• Information from services you connect and from providers that help us run XEL.

3. How We Use It

• To provide, secure, maintain, and improve XEL.
• To create, host, display, fund, and operate Characters.
• To enable account access, wallet connections, ownership checks, memory, chat, media, voice, payment, and profile features.
• To detect fraud, spam, abuse, security issues, sanctions risk, and violations of our Terms.
• To provide support, send service notices, administer credits or refunds where available, and comply with legal obligations.

4. AI Processing

XEL uses AI, compute, retrieval, voice, transcription, and media providers to deliver features you request. Those providers may process content to operate the Services.

We do not use private Character content, private memory, voice data, or private likeness data to train general-purpose AI models for unrelated products unless we have a lawful basis and obtain any required consent. Public content may be visible and processed by design.

5. Blockchain Permanence

XEL uses public blockchains and decentralized storage. Wallet addresses, transactions, ownership records, funding events, fees, Character identifiers, and cryptographic commitments may be public and permanent.

We cannot edit, delete, hide, or reverse public on-chain records. Wallets are pseudonymous, but third parties may link wallet activity to real identities.

Private Character content may be encrypted off-chain. If deletion is available, we may delete or disable the keys needed to read it, but encrypted blobs or on-chain fingerprints may remain on decentralized networks.

Do not put anything on-chain, or in public Character content, that you would not want to be public forever.

6. Characters and Conversations

Characters may remember interactions. If you talk to a Character, your conversation may be stored in that Character's memory depending on its settings, owner choices, and XEL's technical architecture.

If you own or operate a Character, you are responsible for the content and data you provide, the rights and consents behind it, and any notices required for people who interact with your Character.

7. Voice and Likeness

Only use a real person's name, persona, voice, image, or likeness if you have the required rights and consent, including consent from an estate where required. Voice cloning requires authorization.

Voice samples and derived voice models may be treated as biometric or biometric-derived information under some laws. We retain them only as long as needed for the feature, to operate XEL, or to comply with law, subject to the blockchain and decentralized-storage limits described above.

8. Sharing

We do not sell your personal information for money. We may share information:

• With providers that help us run XEL, including hosting, storage, analytics, authentication, payments, communications, security, moderation, AI, compute, voice, media, and retrieval providers.
• Publicly, when you publish content, mark content public, use public Character pages, or create on-chain records.
• For safety, security, legal compliance, law enforcement requests, rights protection, and Terms enforcement.
• With affiliates, in business transfers, or when you direct us to connect or share with a third party.

9. Cookies and Retention

We use cookies, local storage, pixels, and similar tools to operate XEL, remember preferences, measure usage, secure the product, and prevent abuse. You can control cookies through your browser, but some features may require them.

We keep personal information as long as needed to provide XEL, operate Characters, comply with law, resolve disputes, enforce agreements, maintain security, and support legitimate business purposes. Public blockchain records, decentralized storage records, public content, and third-party records may persist outside our control.

10. Your Choices

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of personal information; object to or restrict certain processing; withdraw consent; opt out of certain sales, sharing, targeted advertising, or profiling; and appeal certain decisions.

These rights have limits. We cannot change or delete public blockchain records, and decentralized-storage deletion may be limited to disabling access keys.

To make a request, contact legal@xel.xyz. We may verify your identity or ask you to prove control of a wallet address.

11. Children

XEL is not directed to children. You must be at least 18 years old or the age of majority in your jurisdiction to use XEL. We do not knowingly collect personal information from children under 13 or from children where parental consent would be required. If you believe a child has provided personal information to us, contact legal@xel.xyz.

We prohibit content that sexualizes, exploits, or endangers minors.

12. Security and International Processing

We use reasonable technical and organizational measures designed to protect information. No system is perfectly secure. You are responsible for protecting your wallet, keys, devices, and credentials.

Limitless Labs is based in the United States, and information may be processed in the United States and other countries. Public blockchains and decentralized storage are global by design.

13. Changes and Contact

We may update this Policy from time to time. If we make material changes, we will update the Last updated date and provide notice where required by law.
